    File No. 113/7(G)/Goa/2019/Registry COMMISSION’S OPINION DATED 09.07.2020- REFERENCE FROM HON’BLE GOVERNOR OF GOA ORDER DATED 04.08.2020- DISQUALIFICATION OF SHRI DIGAMBAR KAMAT, MLA Allegation of disqualification- having subsisting contract with government of Goa. It was held that Shri Digambar Kamat did not incur disqualification under Section 9A of the RP Act, 1951, as there was no subsisting contract between him and the appropriate government. The question of deriving indirect monetary benefit was not contemplated under Section 9A. A direct connection between Shri Digambar Kamat and the appropriate government was not established. Further, the decisions relied on by the Petitioner on the principle of Communion of Assets under the Portuguese Civil Code, 1860 were not applicable in the present case as they pertained to the legislations concerning local body elections. Held- Not disqualified.

    No. 491/Media Policy/2019-Communication Dated: 27th November, 2019 To, All Print and Electronic Media Sub: Media Coverage during the period referred to in Section 126A of R.P. Act, 1951 – violations – regarding. Madam/Sir, Attention of all media is invited to the Commission’s letter no. 491/Media Policy/2017 – Communication dated 30th March, 2017 (enclosed) by which the Commission had issued an advisory to all the media (electronic and Print) to refrain from telecasting/publishing programmes which in any way whatsoever predict the results of the elections during the prohibited period under 126A to ensure free, fair and transparent election. 2. The Commission is of the view that prediction of results of elections in any form or manner by way of predictions etc. by Astrologers, Tarot Readers, Political Analysts or by any persons during the prohibited period is violation of the spirit of Section 126A which aims to prevent the electors of constituencies still going to polls from being influenced in their voting by such predictions about the prospects of the various political parties. 3. In view of the above, all the media (Electronic and Print) are hereby advised not to publish/publicize any such article/programme related to the dissemination of results, during the prohibited period between 7.00 AM on 30.11.2019 (Saturday) and 5.30 PM on 20.12.2019(Friday) in the current General Election to the State Legislative Assembly of Jharkhand, 2019.

    No. 52/2020/ VOL.I Dated: 10th January, 2020 To, The Chief Electoral Officer NCT of Delhi Delhi. Subject: Commission’s Notification under Section 60(c) of the RP Act, 1951 for the purpose of voting through postal ballot – regarding. Sir, In continuation of the Commission's letter No. 52/2019/SDR/ETPBS-Vol.II dated 8th January, 2020, I am directed to forward herewith the Commission's Notification No. 52/2020/SDR dated 10th January, 2020 notifying the categories of electors mentioned therein for the purposes of facility of voting through postal ballot as absentee voters on essential service. This may be published in the State Gazette immediately and a copy of the same may also be forwarded to the Commission.

    Voting through postal ballot by Absentee Voters on Essential Service (AVES) By the Conduct of Elections (Amendment) Rules, 2019, ‘Absentee Voters’ have been given the facility of voting through postal ballot paper. Provisions made by the amendments (1) `Absentee Voter’ has been defined in clause (a) of Rule-27A of CE Rules, 1961 as a person belonging to the class of persons notified by the Commission in terms of clause (c) of Section-60 of RP Act, 51 comprising persons employed in essential services who, on account of the compulsion of their duties, are not able to be present in their polling station on the day of poll. This category would also include senior citizens of 80 plus age and those belonging to the category of physically disabled (PWD). (2) The Commission has notified the officials of (i) Delhi Metro Rail Corporation, (ii) Northern Railway (Passenger and Freight) Services and (iii) Media persons to whom authority letters have been issued with the approval of the Commission as absentee voters on the category of essential service for the purpose of the facility of postal ballot voting. Accordingly, the officials of these categories who are enrolled in the electoral roll in Delhi and who would be certified to be on duty on the day of poll (08-2-2020), and on account of theirsuch official duties,will not be able to be present in the polling station for voting on that day, will be eligible for voting through postal ballot as absentee voters in the essential service category. (3) Absentee Voter wishing to vote by postal ballot has to make application to the Returning Officer in Form-12D giving all requisite particulars. In the case of those Absentee Voters belonging to the category of essential services, their application is required to be verified by the Nodal officer appointed by the organisation concerned. Such application seeking postal ballot facility should reach the RO within five days following the date of notification of the election concerned.
