    No. ECI/PN/95/2019 Dated: 18th October, 2019 Press Note Subject: ECI replaces Police Observer of Nashik and Returning Officer of 125 Nashik West Assembly Constituency of Maharashtra. The Election Commission of India has replaced Police Observer of Nashik and one Returning Officer of Nashik district after reviewing the electoral preparedness of the state of Maharashtra. Police Observer was removed for not performing the task of observation satisfactorily. On the basis of input regarding progress of photo voter slip distribution, which is very important to inform each and every elector timely, it was found that the performance of an Assembly Constituency in Nashik district was very poor. Reviewing this, the Commission ordered replacement of the RO 125 Nashik West. The new officers will join today.

    No. 491/MCMC/2019/Communication Dated: 15th October, 2019 To The Chief Electoral Officers of Haryana & Maharashtra. Subject: - Pre-certification of Political Advertisements in Print Media on the day of poll & one day prior to poll in Haryana & Maharashtra– regarding. Sir, I am directed to state that instances of advertisements of offending and misleading nature published in print media have been brought to the notice of the Commission in the past. Such advertisements in the last stage of the election vitiate the entire election process. The affected candidates and parties will not have any opportunity of providing clarification/rebuttal in such cases. 2. In order to ensure that such instances are not repeated, and no untoward incident takes place because of any inflammatory, misleading or hate advertisements, the Commission, in exercise of its powers under Article 324 of the Constitution, and all other powers enabling it in this behalf, hereby directs that no Political Party or Candidate or any other Organization or Person shall publish any Advertisement in the print media on poll day and one day prior to poll day i.e. 20th and 21st October, 2019, unless the contents of the Advertisement proposed to be published by the Political Parties, Candidates etc. are got Pre-certified by them from the MCMC Committee at the State/District level, as the case may be, in your State. 3. It is further directed that in order to facilitate the process of pre-certification of the newspaper advertisements and as instructed above, MCMC at State/district level be immediately alerted and activated in order to examine and pre-certify all such advertisements received from the political parties and candidates and others. It should also be ensured that the decision by MCMC is made expeditiously. 4. The above direction of the Commission may be brought to the notice of Presidents of all political parties, contesting candidates and Newspapers in the State and also given wide publicity to all Media of Mass Communication for general information and strict compliance. 5. These directions shall come into force immediately. 6. A copy of the instruction issued in this behalf may be endorsed to the Commission urgently.

ELECTRONIC VOTING MACHINES (EVMs) and VVPATs The Commission has decided to use EVMs and VVPATs in the bye-election in all the polling stations. Adequate numbers of EVMs and VVPATs have been made available and all steps have been taken to ensure that the polls are conducted smoothly with the help of these machines. 3. IDENTIFICATION OF VOTERS In consonance with the past practice, the Commission has decided that the voter's identification shall be mandatory in the aforementioned election at the time of poll' Electoral Photo Identity cards (EPIC) shall be the main document of identification of a voter. However, in order to ensure that no voter is deprived of his/her franchise, if his/her name figures in the electoral rolls, separate instructions will be issued to allow additional documents for identification of voters at the time of poll in the said election. 4. MODEL CODE OF CONDUCT The Model code of conduct shall come into force with immediate effect in the district(s) in which the whole or any part of the Parliamentary & Assembly constituency going for election is included, subject to partial modification as issued vide Commission’ s instruction No. 437/6/1NST/2016-CCS, dated 29th June, 2017 (available on the commission's website). The Model code of conduct shall be applicable to all candidates, political parties and the state Government concerned. The Model code of conduct shall also be applicable to the Union Government for the district of the State concerned. All the instructions issued for General Elections to Legislative Assemblies of Haryana & Maharashtra shall also be applicable to the aforementioned Bye-election.
