    No. ECI/PN/100/2019 Dated: 25th October, 2019 PRESS NOTE Subject: Schedule for bye-elections to fill four casual vacancies in the State Legislative Assemblies of Uttarakhand and West Bengal – Regarding. There are four vacancies in State of Uttarakhand and West Bengal Legislative Assemblies which need to be filled up are as follows: Sl.No. Name of State Number and Name of Assembly Constituency 1. Uttarakhand 44 – Pithoragarh 2. West Bengal 34 – Kaliaganj (SC) 3. West Bengal 77 - Karimpur 4. West Bengal 224 - Kharagpur Sadar After taking into consideration inputs from the Chief Electoral Officers of Uttarakhand and West Bengal and various factors like local festivals, electoral rolls, weather conditions etc., the Commission has decided to hold bye-elections to fill these vacancies as per the programme mentioned as under: - Poll Events Schedule Date of Issue of Gazette Notification 30.10.2019 (Wednesday) Last Date of Nominations 06.11.2019 (Wednesday) Date for Scrutiny of Nominations 07.11.2019 (Thursday) Last Date for Withdrawal of candidatures 11.11.2019 (Monday) Date of Poll 25.11.2019 (Monday) Date of Counting 28.11.2019 (Thursday) Date before which election shall be completed 30.11.2019 (Saturday) 1. ELECTORAL ROLL The Electoral Rolls for the aforesaid Assembly Constituencies w.r.t 01.01.2019 as the qualifying date has been finally published. 2. ELECTRONIC VOTING MACHINES (EVMs) and VVPATs The Commission has decided to use EVMs and VVPATs in the bye-election in all the polling stations. Adequate numbers of EVMs and VVPATs have been made available and all steps have been taken to ensure that the polls are conducted smoothly with the help of these machines. 3. IDENTIFICATION OF VOTERS In consonance with the past practice, the Commission has decided that the voter's identification shall be mandatory in the aforementioned election at the time of poll. Electoral Photo Identity Cards (EPIC) shall be the main document of identification of a voter. However, in order to ensure that no voter is deprived of his/her franchise, if his/her name figures in the electoral rolls, separate instructions will be issued to allow additional documents for identification of voters at the time of poll in the said elections. 4. MODEL CODE OF CONDUCT The Model code of conduct shall come into force with immediate effect in the district(s) in which the whole or any part of the Parliamentary & Assembly constituency going for election is included, subject to partial modification as issued vide Commission’s instruction No. 437/6/1NST/2016-CCS, dated 29th June, 2017 (available on the Commission's website The Model Code of Conduct shall be applicable to all candidates, political parties and the State Government concerned. The Model Code of Conduct shall also be applicable to the Union Government for the district of the State concerned.

    Commission's Order dated 15th October, 2019, regarding identification of electors at the current bye-elections to the State Legislative Assemblies of Kerala, notified on 23-09-2019 from 01-Manjeshwar, 82-Ernakulam, 102-Aroor, 114-Konni, & 133-Vattiyoorkavu Assembly Constituencies in the State of Kerala. The Commission has directed that all electors in the above said bye elections, who have been issued EPIC have to produce the EPIC for their identification at the polling station before casting their votes. Those electors who are not able to produce the EPIC shall produce one of the alternative photo identity documents mentioned in paragraph 7 of the Order for establishing their identity. The list of documents is reproduced below for clarity: Passport; Driving License; Service Identity Cards with photograph issued to employees by Central/State Govt. PSUs/Public Limited Companies; Passbooks with photograph issued by Bank/Post Office (except passbook issued by Co-operative Banks of Kerala); PAN Card; Smart Card issued by RGI under NPR; MNREGA Job Card; Health Insurance Smart Card issued under the scheme of Ministry of Labour; Pension document with photograph, Official identity cards issued to MPs/MLAs/MLCs Aadhaar Card. Overseas electors shall have to produce their original passport only for identification.

    Whereas, the schedule for the General Elections to the Legislative Assemblies of Haryana & Maharashtra, bye elections from 51 Assembly Constituencies (as per Annexure-I) of 17 States and bye-elections from 23-Samastipur (SC) Parliamentary Constituency in the State of Bihar & 45-Satara Parliamentary Constituency in the State of Maharashtra, were announced by the Commission vide Press Notes dated 21st September, 2019, 22nd September, 2019 and dated 24th September, 2019, with poll scheduled to be taken on 21-10-2019 for all the elections; and 2. And whereas, as per the provisions of Section 126A of The Representation of the People Act, 1951 (in short R.P. Act, 1951) there shall be restrictions on conduct of any exit poll and publication and dissemination of result of such exit poll during such period, as may be notified by the Election Commission in this regard; 3. Now, therefore, in exercise of the powers under sub-Section (1) of Section 126A of the R.P. Act, 1951, the Election Commission, having regard to the provisions of sub-Section (2) of the said Section, hereby notifies the period between 7.00 A.M. and 6.30 P.M. on 21-10-2019(Monday), as the period during which conducting any exit poll and publishing or publicizing by means of the print or electronic media or dissemination in any other manner whatsoever, the result of any exit poll in connection with the above mentioned General Elections to the State Legislative Assemblies of Haryana & Maharashtra and bye elections from 51 Assembly Constituencies (as per Annexure-I) of 17 States and bye elections from 23-Samastipur (SC) Parliamentary Constituency in the State of Bihar & 45-Satara Parliamentary Constituency in the State of Maharashtra, shall be prohibited. 4. It is further clarified that under Section 126(1)(b) of the R.P. Act, 1951, displaying any election matter including results of any opinion poll or any other poll survey, in any electronic media, would be prohibited during the period of 48 hours ending with the hours fixed for conclusion of poll in the respective polling areas in connection with aforesaid General elections and bye-elections
