Sir, I am directed to forward herewith the Commission’s Notification No. 576/Exit/SDR//2020/Vol-Idated 24thJanuary,2020 with the request that this may be published in an extraordinary issue of the gazette of the State and a copy thereof may be sent to the Commission for record. Yours faithfully, (Abhishek Tiwari) Under Secretary ***************************************** TO BE PUBLISHED IN THE OFFICIAL GAZETTE OF STATE IMMEDIATELY ELECTION COMMISSION OF INDIA Nirvachan Sadan, Ashoka Road, New Delhi-110001 No. 576/EXIT/2020/SDR/Vol-I Dated: 24th January, 2020 NOTIFICATION Whereas, the schedule for the General Election to the Legislative Assembly of NCT of Delhi was announced by the Commission vide Press Note No. ECI/PN/4/2020,dated 6th January, 2020; and 2. And whereas, as per the provisions of Section 126A of The Representation of the People Act, 1951 (in short R.P. Act, 1951) there shall be restrictions on conduct of any exit poll and publication and dissemination of result of such exit poll during such period, as may be notified by the Election Commission in this regard; 3. Now, therefore, in exercise of the powers under sub-Section (1) of Section 126A of the R.P. Act, 1951, the Election Commission, having regard to the provisions of sub-Section (2) of the said Section, hereby notifies the period between 8.00 A.M and 6:30 PM on 8th February, 2020(Saturday),as the period during which conducting any exit poll and publishing or publicizing by means of the print or electronic media or dissemination in any other manner whatsoever, the result of any exit poll in connection with the above mentioned General Election to the State Legislative Assembly of NCT of Delhi, shall be prohibited. 4. It is further clarified that under Section 126(1)(b) of the R.P. Act, 1951, displaying any election matter including results of any opinion poll or any other poll survey, in any electronic media, would be prohibited during the period of 48 hours ending with the hours fixed for conclusion of poll in the respective polling areas in each phase of the aforesaid General election.     No.437/DL-LA/4/2020/N.S.-II Dated: 29th January, 2020 ORDER In connection with the current general election to the Legislative Assembly of NCT of Delhi, Bharatiya Janata Party, a recognized National Party, vide their letter dated 21-01-2020, has furnished the names of leaders (star campaigners) of the said Party in terms of the provisions of Explanation 1(a) to subsection (1) to sub-section (1) of Section 77 of the representation of the People Act, 1951. Names of Shri Anurag Thakur and Shri Parvesh Sahib Singh were among the list of forty leaders furnished by the Party. The Commission has noticed that Shri Anurag Thakur and Shri Parvesh Sahib Singh have made statements/speeches contents of which were in violation of the letter and spirit of the various provisions of the Model Code of Conduct for Political Parties and Candidates. The Commission has issued Notices to the said leaders regarding action against them under the Model Code of Conduct. The Commission has also issued a general Advisory to all political parties to instruct their functionaries and candidates to the provisions of the Model Code of Conduct.

Subject: Commission’s Notification under Section 60(c) of the RP Act, 1951 for the purpose of voting through postal ballot – regarding. Sir, In continuation of the Commission's letter No. 52/2019/SDR/ETPBS-Vol.II dated 8th January, 2020, I am directed to forward herewith the Commission's Notification No. 52/2020/SDR dated 10th January, 2020 notifying the categories of electors mentioned therein for the purposes of facility of voting through postal ballot as absentee voters on essential service. This may be published in the State Gazette immediately and a copy of the same may also be forwarded to the Commission.

    Voting through postal ballot by Absentee Voters on Essential Service (AVES) By the Conduct of Elections (Amendment) Rules, 2019, ‘Absentee Voters’ have been given the facility of voting through postal ballot paper. Provisions made by the amendments (1) `Absentee Voter’ has been defined in clause (a) of Rule-27A of CE Rules, 1961 as a person belonging to the class of persons notified by the Commission in terms of clause (c) of Section-60 of RP Act, 51 comprising persons employed in essential services who, on account of the compulsion of their duties, are not able to be present in their polling station on the day of poll. This category would also include senior citizens of 80 plus age and those belonging to the category of physically disabled (PWD). (2) The Commission has notified the officials of (i) Delhi Metro Rail Corporation, (ii) Northern Railway (Passenger and Freight) Services and (iii) Media persons to whom authority letters have been issued with the approval of the Commission as absentee voters on the category of essential service for the purpose of the facility of postal ballot voting. Accordingly, the officials of these categories who are enrolled in the electoral roll in Delhi and who would be certified to be on duty on the day of poll (08-2-2020), and on account of theirsuch official duties,will not be able to be present in the polling station for voting on that day, will be eligible for voting through postal ballot as absentee voters in the essential service category. (3) Absentee Voter wishing to vote by postal ballot has to make application to the Returning Officer in Form-12D giving all requisite particulars. In the case of those Absentee Voters belonging to the category of essential services, their application is required to be verified by the Nodal officer appointed by the organisation concerned. Such application seeking postal ballot facility should reach the RO within five days following the date of notification of the election concerned.
