    NOTICE
    Whereas, the General Election to the House of People, 2019 has been announced by the Election Commission of India on 10th March, 2019, vide its press release no. ECI/PN/23/2019, dated 10th March, 2019 and the provisions of Model Code of Conduct have come into force from that date as made clear in para- 32 of the said press release; and
    Whereas, the Commission has called upon all the political parties, candidates and the Union/State Govts. and UT Administrators to strictly adhere to the Model Code of Conduct vide para-32 of the said press release; and
    Whereas, sub- para (1) of para 1 of the Model Code of Conduct, provides, inter alia, that no party or candidate shall indulge in any activity which may aggravate existing differences or create mutual hatred or case tension between different castes and communities, religious or linguistic; and sub- para (3) of para 1, inter alia, prohibits appeal to communal feelings for securing votes; and
    Whereas, the Commission has received a complaint from Sh. M Rama Raju, State President, Viswa Hindu Parishad wherein the complainant has stated that you have tried to secure votes by passing derogatory remarks "EE HINDU GAALU......BONDU GAALU......DIKKUMALINA.......DARIDRAPU GAALU" and DESHAM LO AGGI PETALE, GATTAR LEVALE" against Hindus while addressing an election rally at Karimnagar on 17.03.2019; and
    Whereas, the Commission has obtained English version of the speech delivered on 17.03.2019 and factual report from the Chief Electoral Officer, Telangana and the Commission has examined the English version of the speech; and Whereas, the Commission, is prima facie, of the opinion that by making the aforesaid statement which has the potential of disturbing harmony and aggravating the existing differences between social and religious communities, and appealing to communal feelings, you have violated the above said provisions of the Model Code of Conduct.
    Now, therefore, the Commission gives you an opportunity to submit explanation, if any in this regard on or before 5 P.M. of 12th April, 2019, failing which the Election Commission shall take a decision without any further reference to you.

     Sub:    Media Coverage during the period referred to in Section 126 A of RP Act, 1951 – violations – regarding.
     Madam/Sir,
                Attention of all media is invited to the Commission’s letter no. 491/Media Policy/2017 – Communication dated 30th March, 2017 (enclosed) by which the Commission had issued an advisory to all the media (electronic and Print) to refrain from telecasting/publishing programmes which in any way whatsoever predict the results of the elections during the prohibited period under 126A to ensure free, fair and transparent election.
    2.         The Commission is of the view that prediction of results of elections in any form or manner by way of predictions etc. by Astrologers, Tarot Readers, Political Analysts or by any persons during the prohibited period is violation of the spirit of Section 126A which aims to prevent the electors of constituencies still going to polls from being influenced in their voting by such predictions about the prospects of the various political parties.
    3.         In view of the above, all the media (Electronic and Print) are hereby advised not to publish/publicize any such article/programme related to the dissemination of results, during the prohibited period i.e. between 7.00 AM on 11.04.2019 (Thursday) and up to 6.30 PM on 19.05.2019 (Sunday) in the current General Elections to the Lok Sabha and State legislative assemblies of Andhra Pradesh, Arunachal Pradesh, Odisha & Sikkim, 2019 and the Assembly bye-elections being held in several states to ensure free and fair elections as stated above in the Commission’s communication.
