  1. General Elections to State Legislative Assemblies of Haryana & Maharashtra - Advisory for Transfer/Posting of officers connected with conduct of elections - regarding.

    The term of existing State Legislative Assemblies of Haryana & Maharashtra is upto 2nd November, 2019 and 9th November, 2019, respectively.
    2. To ensure free and fair election, the Commission has been following a consistent policy to the effect that officers directly connected with conduct of elections in an election going State/UT are not posted in their home districts or places where they have served for considerably long period. Keeping this in view, detailed transfer/posting instructions were issued vide letter of even number dated 16th January, 2019 in respect of the General Election to House of the People (Lok Sabha),2019 and State Legislative Assemblies of Andhra Pradesh, Arunachal Pradesh, Odisha and Sikkim. (copy enclosed).
    3. Accordingly, it is hereby advised that in respect of all government officers directly connected with the conduct of elections the following may be ensured
     that she/he is not posted in her/his home district that she/he has not completed three years in that district during last four (4.) years or would be completing 3 years on or before 31st October, 2019. that no DEO/RO/ARO/Poiice inspectors/Sub-inspector or above is posted back or allowed to continue in the AC/district where he/she was posted during the General/Bye elections held in the Assembly/Parliamentary Constituency prior to 31st October, 2017. that the officers/officials against whom the Commission had recommended disciplinary action in past and which is pending or which has resultedin a penalty or the officers who have been charged for any lapse in any election or election related work in the past, may not be assigned any election related duty. Further, any officer, who is due to retire within the coming six months, shall not be associated with any election related duty. 4. The Commission's aforesaid advisory may be brought to notice of all concerned for strict and timely compliance.

    I am directed to state that the Commission, taking all aspects into consideration especially the impending general election to the Legislative Assembly in the States and with a view to providing further opportunity to un-enrolled eligible persons to get their names registered in the electoral roll so that they are not deprived of voting in elections and to improve the health of the electoral roll at the same time, has directed to undertake 2nd Special Summary Revision of Photo Electoral Rolls w.r.t. 01.01.2019 as qualifying date in the poll going States, namely Haryana and Maharashtra as per the schedule below:-

    Subject:       Carrying of Mobile Phone by Returning Officers/ Assistant Returning Officers inside the Counting Hall – reg.
    Reference:    1. The ECI’s instruction No.470/INST/2014-EPS, dated 8th May, 2014.
                         2. The ECI’s instruction No.470/INST/2014-EPS, dated 15th May, 2014. 
     Sir/Madam,
                        I am directed to invite your attention to the Commission’s instructions referred above and to state that in view of inception of Electronically Transmitted Postal Ballot Paper System (RTPBS) wherein One-Time Password (OTP) is received on mobile phones, the Commission has directed that on the day of counting,
    (i)  Only that mobile phone of the RO/ARO/Counting supervisor/s, linked to ETPBS, to be used to receive ‘OTP’ to log into ETPBS to start counting thereof have to be brought inside the counting hall;
    (ii)   The mobile handsets will be switched on only to receive ‘OTP’ and be switched off once the system is logged on to ETPBS;
    (iii)   Inside the counting hall, such mobile handsets are to be kept in the custody of ARO/RO/Observer, whosoever is the senior most officer in the Counting Hall for ETPBS counting, in switched off mode till the counting is over.
    (iv)  In case login is closed for some reasons, Counting Supervisor can get the mobile from the officer to whom the mobile set was submitted to receive OTP once again for enabling him to re-login, and after re-login, he should return the mobile to same officer in switched off mode.
    (v)   A declaration be got signed by all users separately about Dos and Don’ts for mobile usage.
    (vi)   Specific permission be sought from concerned CEO for number of users in each case with the requisite mobile phone numbers being used. Mobile phones are to be allowed inside the Counting hall for all such users.
