     Subject: General Election to the State Legislative Assemblyof NCT of Delhi, 2020- Commission’s order regarding identification of electors.
    Sir,
               I am directed to enclose herewith Commission's Order dated 16thJanuary, 2020 regarding identification of electors at the General Election to the State Legislative Assembly of NCT of Delhi.
    2.         The Commission has directed that all electors in all constituencies who have been issued EPIC have to produce the Electors Photo Identity Card (EPIC) for their identification at the polling station before casting their votes. Those electors who are not able to produce the EPIC shall produce one of the alternative photo identity documents mentioned in paragraph 7 of the Order for establishing their identity. The list of documents is reproduced below for clarity:
    (i) Passport,
    (ii) Driving License,
    (iii)Service Identity Cards with photograph issued to employees by Central/State Govt./PSUs/Public Limited Companies,
    (iv) Passbooks with photograph issued by Bank/Post Office,
    (v) PAN Card,
    (vi) Smart Card issued by RGI under NPR,
    (vii) MNREGA Job Card,
    (viii) Health Insurance Smart Card issued under the scheme of Ministry of Labour,
    (ix) Pension document with photograph,
    (x) Official identity cards issued to MPs/MLAs/MLCs, and
    (xi) Aadhaar Card.
    3.         In the case of EPIC, minor discrepancies in the entries therein should be ignored provided the identity of the elector can be established by the EPIC. If an elector produces an EPIC which has been issued by the Electoral Registration Officer of another Assembly Constituency, such card shall also be accepted for identification provided the name of that elector finds place in the electoral roll pertaining to the polling station where the elector has turned up for voting. If it is
    not possible to establish the identity of the elector on account of mismatch of photograph, etc. the elector shall have to produce one of the alternative photo documents mentioned in Para 7 of the Order.
    4.         On earlier occasions, the Commission had allowed Photo Voter Slip as a document for identification. However, there have been representations against its use as a stand-alone identification document on the grounds of misuse as these are printed after the finalization of the roll and distributed just close to the poll through Booth Level Officers. The design of Photo Voter Slip does not incorporate any security feature. In fact, Photo Voter Slip was started as an alternative document as the coverage of EPIC was not complete. As per available information, at present, 100 per cent electors possess EPIC, and more than 99 per cent adults have been issued Aadhaar Cards. Taking all these facts in view, Commission has now decided that Photo Voter Slip shall henceforth not be accepted as a stand-alone identification document for voting. However, Photo Voter Slip will continue to be prepared and issued to electors as part of the awareness building exercise. In order to make it clear to the electors that Photo Voter Slips shall not be accepted as a stand-alone identification document for voting, the words 'THIS SLIP WILL NOT BE ACCEPTED FOR THE PURPOSE OF IDENTIFICATION IN POLLING STATION. YOU ARE REQUIRED TO CARRY EPIC OR ONE OF THE 11 ALTERNATIVE DOCUMENTS SPECIFIED BY THE COMMISSION FOR VOTING" shall be printed on the Photo Voter Slip in bold letters. Photo Voter Slips shall continue to be printed.
    5.         Overseas electors shall have to produce their original passport only for identification.
    6.         The Order may be brought to the notice of the Returning Officers and all Presiding Officers. A copy of the Order translated in the vernacular language should be supplied to each of the Presiding Officers. The Order shall be got published in the StateGazette, immediately. This Order shall also be given wide publicity through print/electronic media for information of the general public and electors immediately and subsequently at regular intervals till the date of polling. This should include paid Advertisements in the newspapers. All political parties in your State/UT and contesting candidates may also be informed, in writing, regarding these directions.
    7.         The Returning Officers shall explain the implications of this Order and explain the contents thereof to all Presiding Officers through special briefings. They should also ensure that a copy of this letter is available with the Presiding Officers at all polling stations /booths in the constituency.

     Sir,
    I am directed to enclose herewith the Commission’s Direction dated  14thJanuary, 2020, regarding use of Electronic Voting Machines and VVPAT at the current General Election to the Legislative Assembly of NCT of Delhi. The Direction may be published in the Official Gazette of NCT of Delhi immediately.
    2.         I am further directed to invite your attention to the Rules 49A, 49B, 49P and 49T(2) of the Conduct of Elections Rules, 1961, relating to the designs of voting machines, form and language(s) of the ballot paper on the balloting unit, design and language of tendered ballot paper and the manner of sealing of voting machines after the poll. The related instruction in this regard contained in the Chapter on‘Postal Ballot Papers and Ballot Papers for Voting Machines’, in Returning Officers’ Handbook, 2019edition may kindly be followed. Attention is also invited to the instructions regarding use of VVPAT system and sealing of the paper slip after counting is completed.
    3         The above mentioned instructions may be brought to the notice of the Returning Officers of the Constituencies concerned for their information and compliance.
    4.         The aforesaid decision of the Commission may also be given wide publicity.
    5.         As regards counting of votes, your attention is invited to the provisions of Rules 50 to 54A, 60 to 66A and 55C to 57C of the Conduct of Elections Rules, 1961, and also the Commission’s detailed directions and instructions relating to counting of votes as contained in the Returning Officers’ Handbook, 2019 and the other supplementary instructions issued on the subject, from time to time.  The Returning Officers should be instructed to follow the said directions and instructions scrupulously.

                No.576/3/EVM/2020/SDR-Vol.I:- Whereas, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by Voting Machines in such manner as may be prescribed, may be adopted in such constituency or constituencies as the Election Commission of India may, having regard to the circumstances of each case, specify; and
    2.         Whereas, as per the proviso to Rule 49A of the Conduct of Elections Rules, 1961, a Printer with a drop box of such design, as may be approved by the Election Commission of India, may also be attached to voting machine for printing a paper trail of the vote, in such constituency or constituencies or parts thereof as the Election Commission of India may direct; and
    3.         Whereas, the Commission has considered the circumstances in all the Constituencies for theGeneral Election to the Legislative Assembly of NCT of Delhi announced by the Commission’s Press Note No. ECI/PN/4/2020 dated 6th January, 2020 ,and is satisfied that sufficient number of Electronic Voting Machines and Printers for printing Paper Trail [Voter Verifiable Paper Audit Trail(VVPAT)] are available for taking the poll in all the Assembly Constituencies of NCT of Delhi, the polling personnel are well trained in efficient handling of the Electronic Voting Machines and Printers for Paper Trail (hereafter referred to as ‘VVPAT Printers’) and the electors are also fully conversant with the operation of the Electronic Voting Machines and the VVPAT  Printers;
     4.         Now, therefore, the Election Commission of India, in exercise of its powers under the said Section 61A of the Representation of the People Act, 1951, and Rule 49A of the Conduct of Elections Rules, 1961, hereby specifies all the Assembly Constituencies of NCT of Delhi for the general election to the Legislative Assembly notified on 14-01-2020as theconstituencies in which the votes,shall be given and recorded by means of Electronic Voting Machines and  VVPAT printers in the manner prescribed, under the Conduct of Elections Rules, 1961, and the supplementary instructions issued by the Commission from time to time on the subject.
      5.         The Commission also hereby approves the design of the Electronic Voting Machine and the Printer with the drop box (the VVPAT Printers) as developed by the Bharat Electronics Ltd., Bangalore and Electronics Corporation of India Ltd., Hyderabad, which shall be attached to the said machines, to be used for the giving and recording of votes in all the Constituencies.

    I am directed to forward herewith a copy of the Direction dated 13thJanuary, 2020 issued by the Commission in terms of second proviso to sub-rule (1) of Rule 23 of the Conduct of Elections Rules, 1961, laying down the manner of transmitting postal ballot papers electronically for transmission of postal ballots for service voters at the current General Election to the State Legislative Assembly of  NCT of Delhi.

    In terms of the provisions of the Second Proviso to sub-rule(l) of Rule 23 of the Conduct of Elections Rules, 1961, the Commission hereby lays down the following manner for transmission of postal ballot papers by electronic means to the service voters and counting of the postal ballots received back from service voters: -
    1. Documents to be transmitted -
     The Returning Officer shall transmit the following documents electronically:
    (a) Postal Ballot Paper,
    (b) Form 13-A-Declaration by Elector,
    (c) Label for Form 13-B- Cover A (Inner Envelope),
    (d) Label for Form l3-C-Cover B (Outer Envelope),
    (e) Form l3-D- Instructions for the Guidance of Elector.
    2. Mode of transmission-
    After the Central Administration Officer (C- Admin) activates the RO operations regarding release of postal ballot paper electronically, the Returning Officer shall be able to log into the system and perform the following activities.
    a. Enter/view the data for the election of his constituency as per the election schedule (i.e. description of the election, state code of constituency, type of constituency (AC or PC), number of constituency, name of constituency, date of the election and RO address for mailing/dispatching back the marked Postal          
    b. Enter/view the download window (i.e. start date and time and end date and time) for Postal Ballot
    c. Load template of the Postal Ballot Paper specific to his constituency
    d. View and approve the sample Postal Ballot generated by the system

    By the Conduct of Elections (Amendment) Rules, 2019, ‘Absentee Voters’ have been given the facility of voting through postal ballot paper.
    Provisions made by the amendments
    (1)   `Absentee Voter’ has been defined in clause (a) of Rule-27A of CE Rules, 1961 as a person belonging to the class of persons notified by the Commission in terms of clause (c) of Section-60 of RP Act, 51 comprising persons employed in essential services who, on account of the compulsion of their duties, are not able to be present in their polling station on the day of poll.  This category would also include senior citizens of 80 plus age and those belonging to the category of physically disabled (PWD). 
    (2)   The Commission has notified the officials of (i) Delhi Metro Rail Corporation, (ii) Northern Railway (Passenger and Freight) Services and (iii) Media persons to whom authority letters have been issued with the approval of the Commission as absentee voters on the category of essential service for the purpose of the facility of postal ballot voting.  Accordingly, the officials of these categories who are enrolled in the electoral roll in Delhi and who would be certified to be on duty on the day of poll (08-2-2020), and on account of theirsuch official duties,will not be able to be present in the polling station for voting on that day, will be eligible for voting through postal ballot as absentee voters in the essential service category. 
    (3)   Absentee Voter wishing to vote by  postal ballot has to make application to the Returning Officer in Form-12D giving all requisite particulars.  In the case of those Absentee Voters belonging to  the category of essential services, their application is required to be verified by the Nodal officer appointed by the organisation concerned.  Such application seeking postal ballot facility should reach the RO within five days following the date of notification of the election concerned.

     Madam/Sir,
                Attention of all media is invited to the Commission’s letter no. 491/Media Policy/2017 – Communication dated 30th March, 2017 (enclosed) by which the Commission had issued an advisory to all the media (electronic and Print) to refrain from telecasting/publishing programmes which in any way whatsoever predict the results of the elections during the prohibited period under 126A to ensure free, fair and transparent election.
    2.         The Commission is of the view that prediction of results of elections in any form or manner by way of predictions etc. by Astrologers, Tarot Readers, Political Analysts or by any persons during the prohibited period is violation of the spirit of Section 126A which aims to prevent the electors of constituencies still going to polls from being influenced in their voting by such predictions about the prospects of the various political parties.
    3.         In view of the above, all the media (Electronic and Print) are hereby advised not to publish/publicize any such article/programme related to the dissemination of results, during the prohibited period between 7.00 AM on 30.11.2019 (Saturday) and 5.30 PM on 20.12.2019(Friday) in the current General Election to the State Legislative Assembly of Jharkhand, 2019.

    Sir/Madam,
    I am directed to refer to the Commission’s letters mentioned above on the subject cited whereby schedule for the Special Summary Revision of Photo Electoral Rolls w.r.t. 01.01.2020 and Electors Verification Programme (EVP) along with the necessary instructions/guidelines were communicated. The Commission has reviewed the progress of EVP andobserved that large numbers of Forms received for inclusion/deletion/correction, are yet to be disposed of before draft publication. The Commission has also received requests from some CEOs for more time to complete the remaining work.
    2.         Keeping in view the position stated above,the Commission has decided to extend the period for completion of EVP and accordingly change the schedule of SSR, 2020, as per the table given below.

    Sir,
    I am directed to state that as per existing policy, revision of electoral rolls with reference to 1st January of the coming year as the qualifying date is done in later part of each year in all States/UTs (normally in the last quarter of a year). Since general election to Legislative Assemblies of Haryana and Maharashtrahave recently been concluded, the commission has decided that a Special Summary Revision be undertaken in the States of Haryana and Maharashtra to give opportunity to the left out electors and new electors who are going to be eligible for enrollment with reference to 01.01.2020as the qualifying date.              2.         The Commission has decided that the revision shall be a Special Summary Revision with reference to 01.01.2020 as the qualifying dateand shall be undertaken as per the above schedule, in accordance with provisions contained inManual on Electoral Roll, 2016 along with subsequent relevant instructions.
    3.         The CEO shall go through the schedule and if any minor change in the above schedule is required, a request should be made with full justification to the Secretary/Pr.Secretary in charge of the concerned territorial division in the Commission,for the Commission’s approval within seven days from the date of issue of this letter. No change in the schedule approved by the Commission will be permitted, thereafter.

    Allegation of disqualification- for- holding office of profit- Co-Chairperson in District Disaster Management Authorities in 11 districts in Delhi.
    Constitution of India- disqualification under Section 15(1)(a)- Held- not disqualified- no remuneration by way of salary, allowances, sitting fee etc. nor any other facility like staff car, office space, supporting staff, telephone, residence provided – Exemption under Item 14 of Schedule to Delhi Members of Legislative Assembly (Removal of Disqualification Act, 1997.
    The Election Commission held that Item 14 of the Schedule to Delhi Members of Legislative Assembly (Removal of Disqualification Act), 1997 provides for exemption for the office of Chairman, Director or Member of a statutory or non-statutory body or committee etc. constituted by Government of NCT, provided that the said Chairman, Director or Member are not entitled to any remuneration.
